PORTUGAL RESIDENCE PERMIT UNDER ARTICLE 91 WITHOUT A RESIDENCE VISA

Portugal provides a legal route for certain third-country nationals who entered Portugal legally to apply for a higher-education student residence permit, even if they do not hold a Portuguese residence visa.

This procedure is regulated principally by Article 91(4) of Law No. 23/2007 (Lei n.º 23/2007) and is commonly referred to as a dispensa de visto de residência, meaning an exemption from the requirement to hold a residence visa.
Under Article 91(4), a higher-education student who does not hold the residence visa normally required under Article 62 may still be granted a Portuguese residence permit if the applicant entered Portugal legally and meets the remaining requirements applicable to higher-education students.

WHO MAY QUALIFY UNDER ARTICLE 91(4)?
You may potentially qualify if you are a non-EU/EEA/Swiss national and:
• You are physically present in Portugal.
• You entered Portugal legally.
• You hold a valid passport or travel document.
• You have been admitted and enrolled in a Portuguese higher-education institution.
• You have paid the tuition fees required by the institution, where applicable.
• You have sufficient means of subsistence.
• You have suitable accommodation in Portugal.
• You have health insurance or are covered by Portugal's National Health Service, where applicable.
• You can provide the required criminal-record certificate.
• You satisfy the general residence-permit conditions.
• You are not subject to a relevant entry or stay prohibition.
• You do not have a SIS or Portuguese immigration-system indication preventing the granting of residence.
The Portuguese Immigration Process specifically states that a higher-education student without the Article 62 residence visa may receive a residence permit provided the person entered Portuguese territory legally and meets the remaining conditions of Article 91.
